SongBird, Inc. and its subsidiaries and affiliates (collectively, "SongBird," "Flock," "we," "us," and "our") are committed to respecting the privacy of personal information. This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information. By accessing or using our Services, you acknowledge that you have reviewed this Privacy Policy.
1. Scope of this Privacy Policy
This Privacy Policy applies to personal information we process when you:
- Access or use our website at flockdealer.com and any other website operated by us where this Privacy Policy is posted (the "Website");
- Access or use the FlockConnect platform and related tools, including the FlockCover, FlockFinance, and FlockProtect verticals (the "Platform"); or
- Communicate with us by email, text message, phone, or at events.
We refer to the Website, the Platform, and related online services that link to this Privacy Policy as the "Services."
This Privacy Policy applies to: visitors to the Website; individuals associated with our dealer customers and prospective customers ("Dealer Customers") who communicate with us or use the Platform; and the authorized users our Dealer Customers register to use the Platform ("Authorized Users").
Authorized Users and Customer Content. We provide the Platform to Dealer Customers under our agreement with them. We act as a service provider / data processor of the data that Dealer Customers and their Authorized Users input, upload, or make available through the Platform, and of consumer data we process on their behalf (collectively, "Customer Content"). Our processing of Customer Content is governed by our agreement with the Dealer Customer and our Data Processing Addendum, and the Dealer Customer is responsible for the collection and use of that Customer Content.
Out of scope. This Privacy Policy does not apply to individual vehicle shoppers, buyers, or service customers of a Dealer Customer whose information we process through the Platform on the dealer's behalf. If you are a consumer of a dealership that uses Flock, the dealership's own privacy notice governs that information. This Privacy Policy also does not apply to third-party websites we link to.
2. Personal Information We Collect and How
"Personal information" means information that identifies or could reasonably be used to identify an individual. It does not include aggregated or de-identified information.
(a) Information you provide. Identity and contact information (name, business email, business phone); registration and account information (company, job title, login credentials, account ID); payment information (processed through our third-party payment processors); support requests; communications, feedback, survey responses, and event registrations; and marketing preferences.
(b) Information we collect automatically. When you use the Services we and our service providers collect technical data (IP address, browser type and settings, device identifiers, approximate location, log and crash data), usage information (features used, clickstream, pages viewed, referring/exit URLs, email opens and clicks), and information collected through cookies and similar technologies (see Section 5).
(c) Customer Content. Through the Platform's DMS and CRM integrations, we receive and process data about a Dealer Customer's prospects, sales customers, and service customers — which may include contact details, vehicle and ownership information, and, for the FlockCover/FlockFinance/FlockProtect verticals, certain nonpublic personal financial and insurance-related information. We process this Customer Content under our agreement with the Dealer Customer; the dealer's privacy notice applies to it.
(d) Information from third parties. We may receive information from our service providers and agents, from analytics, marketing, and lead-generation providers, from Product Partners (insurance carriers, lenders, and protection-product administrators), and from data-enrichment vendors, and may combine it with information we already hold.
We do not intentionally collect sensitive categories of personal information (such as genetic data, health, race, or religion) to provide the Services.
3. How We Use Personal Information
We use personal information to: provide, operate, secure, and support the Services and manage accounts; process billing and payments; provide transactional notices; personalize, improve, and develop the Services and new features; produce aggregated analytics and benchmarks; send newsletters and marketing communications (subject to your choices); respond to inquiries and interact with you at events; and meet legal, security, audit, and compliance obligations, including enforcing our agreements, detecting fraud, and handling business transfers. We may combine information we collect as a controller with information from third parties for these purposes.
For the FlockCover, FlockFinance, and FlockProtect verticals, we and our Product Partners use the information needed to present, quote, underwrite, and service insurance, financing, and protection products in accordance with GLBA and applicable insurance-privacy laws.
4. How We Disclose Personal Information
We disclose personal information to: corporate account administrators and other Authorized Users of a Dealer Customer's account; our affiliates and subsidiaries; service providers (hosting, analytics, payment processing, advertising and marketing, call-tracking and messaging, CRM and support, security and fraud prevention, and professional advisors); Product Partners for the FlockCover/FlockFinance/FlockProtect verticals; third-party AI providers that power certain Platform features; and others for legal, compliance, and regulatory purposes or in connection with a business transfer. We disclose personal information for law-enforcement purposes only in response to valid legal process, except in a good-faith emergency. We disclose with your consent where additional sharing is requested.
We do not sell personal information for money. To the extent any sharing for cross-context behavioral advertising is considered a "sale" or "share" under the CCPA, see Section 11 for your opt-out rights.
5. Cookies and Tracking Technologies
We and our service providers use cookies, pixels, local storage, and embedded scripts to operate the Services, remember preferences, measure performance, conduct analytics, and deliver and measure advertising. Categories include necessary, functional, analytical, performance, and advertising cookies. You can manage cookies through our cookie banner/preferences manager, your browser settings, Global Privacy Control and privacy plug-ins, the Google Analytics opt-out add-on, and the DAA (optout.aboutads.info) and NAI (optout.networkadvertising.org) opt-out tools.
6. "Do Not Track"
There is no industry consensus on how to respond to "Do Not Track" browser signals, and our Services do not currently respond to them except as required by law. We honor recognized opt-out preference signals (such as Global Privacy Control) where required.
7. Payment Processors
We do not directly store full payment-card information; payments are processed by third-party processors under their own privacy policies.
8. Third-Party Links and Social Features
The Services may link to or embed third-party websites and social-media features that collect information under their own privacy policies. We are not responsible for those third parties' practices.
9. Children's Privacy
The Services are not intended for anyone under 18, and we do not knowingly collect personal information from children under 18. If you believe a child has provided us personal information, contact us using Section 16.
10. How Long We Retain Personal Information; Security
We retain personal information for as long as needed for the purposes in this Policy and as required by law, considering the amount, nature, and sensitivity of the information. We implement reasonable and appropriate administrative, technical, and physical safeguards designed to protect personal information, including the safeguards required by the GLBA for nonpublic personal financial information. No method of transmission or storage is completely secure.
11. Your Privacy Rights and Choices
Marketing. You may opt out of marketing emails via the "unsubscribe" link and of SMS marketing by replying with the opt-out keyword; we may still send transactional messages.
U.S. state privacy rights. Depending on your state of residence (for example, California under the CCPA/CPRA, and other states with comprehensive privacy laws), you may have rights to know/access, correct, delete, and port your personal information, to opt out of "sale"/"share" and targeted advertising, and to non-discrimination for exercising these rights. To exercise rights regarding information we process as a controller, contact us using Section 16. If your request concerns information we process as a service provider/processor on behalf of a Dealer Customer (for example, your information as a shopper or customer of a dealership), we will direct your request to, or act on the instructions of, the relevant Dealer Customer.
GLBA notice. Nonpublic personal financial information collected through FlockCover, FlockFinance, and FlockProtect is handled in accordance with the GLBA and the applicable privacy notice provided in connection with that product.
California "Shine the Light" and Nevada. California residents may request information about disclosures for third-party direct marketing; we do not currently share personal information for third parties' own direct marketing. Nevada consumers may opt out of the sale of covered information; we do not currently sell covered information as defined under Nevada law.
We will verify your identity before fulfilling a request and respond within the timeframes required by applicable law. You may use an authorized agent where the law permits.
12. International Data Transfers
We are based in the United States and process information here. If you access the Services from outside the U.S., you understand your information will be processed in the U.S., where data-protection laws may differ from those of your country.
13. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. We will revise the "Last Updated and Effective Date" above and post the updated Policy on the Services. Material changes will be notified as required by law.
